You are not required by law to offer a warranty. They chose to offer a one year warranty. The fact that they are out of product or replacement parts is not your problem. When this happens to other companies they eat the loss and give you a free upgrade.

Interesting

I have dark matter open beach rod that had the same issue, reel seat de-laminated and came loose. They replaced the lower section, and the replacement had the same thing happen but not as severe. I just fish it as is, i honestly like the rod. I just don’t like the assembly.

I figured I would add to my own post. When they replaced tge lower of my dark matter OB there was no charge, they said it was a manufacturing defect and the transaction was smooth. I was in store and they gave me a replacement on the spot. So that was excellent.

I thought everything you buy in MA has a one year warranty?

Hi Guys, it's Josh. I figured I would jump in here just so we have all the facts straight. In this case the customer (shark lobster) purchased a Dark Matter Fishaholic Surf Rod which was discontinued. The rod originally retailed for $250. He purchased it for $99.99. He went fishing and unfortunately broke the rod. The warranty for this rod is $100 and you get a replacement rod. With the rod being discontinued he would basically be paying a warranty fee which is equal to what he paid for the rod. Because the rod is discontinued we do not have replacements. I offered him a similar rod, the Dark Matter John Skinner 9'2" Surf Rod in its place. This rod retails for $299.99. I told him he would pay $150 ($100 warranty fee and $50 for the difference in retail cost between the two rods). I think this is extremely fair and fits within the stated warranty policy.

If anyone ever has an issue with a purchase from J&H or a Dark Matter product, instead of posting on SO, IG, FB or anywhere else on the Internet, it is best just to email or call me. I have no desire to treat anyone unfairly or to take advantage of anyone. I will take care of you to the best of my ability. On the flip side, you have to have realistic expectations as to what I can do.

And like i said how is that a warrenty ? Offering me a rod that is more money than what i paid for original rod is not a warrenty in my eyes its not my fault you dont have the replacement but its ok i will eat the rod seeing the skinner rod does not fit my needs ! Ive had issues with st croix rods a mojo to be exact they dont make it anymore so i had to pay a up grade fee of 50$

Way to keep your customer happy, and it sounds like he's not the only person that's been unhappy.

I think this forum tells good about companies and plug builders when they are treated fairly if you get my drift

This is why shops hate rods in general. But have to accept it.  They need to sell rods. Lol.

Who and how can someone say its a genuine  manufacturer defect or user error.

It's a rock and another rock and then another hard place situation.

I was gonna ask that same question.

And I am pretty sure if you took a discontinued rod back to any  manufacturers you'd probably have to pay a small upgrade fee.   I had to with a st Croix I had they didn't have any in stock at the time.   It's the same on most reels too if they can't be fixed.

So he's just suppose to eat $150 because a customer comes in and says my rod broke?

So to sum this up you knew about the warranty fee up front?

They asked you to pay a $50 upgrade fee to replace a rod which isn't out of the ordinary when a rod can't be replaced?

We also have no idea if the rod broke from a defect or user error?

Yup.

I'm part of the team that doesn't take advantages of warranty.  If I know it's user error and I break it.  I don't mind paying for a replacement or service.

If I know for sure it's a defect and it's an extremely visible defect, happens first trip out. A guide eye pops out, a whipping cracks and the guide falls off, a reel seat cracks in half. A ferrule or spigot splits down the middle. the blank starts to delaminate in layers. Then I'll ask for the warranty.

Most rods don't break all the sudden.
