Is This Punishable By Law?

Saw a DEC officer at Shinnecock East on Sunday afternoon. Lots of folks blackfishing and he paid this group a visit. Checked ONE for fishing registry and had them throw back ( dead) one short tog.  No tickets issued.

Love seeing some enforcement, but definitely need some actual punishments issued for not following the law. What’s the point of having all of these discussions about regulations if no one is going to follow them because they know nothing will happen when they’re caught (if they ever are). 
 

I wonder why aren’t boat ramps monitored more often. In my experience, I have NEVER been “checked” or had an encon officer approach me in my decade of fishing from boat. Makes me wonder how much poaching from Rec has impacted this fishery that no one has a real gauge on.

Called DEC once and they promptly made the guy put the short DEAD striper (which was hidden in an umbrella inside the trash can) back into the water, where it floated away belly up. No summons issued and no punishment.

 

Guy was back the next day doing the same thing. Only this time he learned to filet his tiny fish as soon as he caught it and run back to his car cooler.

 

Sad.

There's just not enough officers. Seems like it's the same song and dance in each state. When I was a city cop, I'd sit down at the Navy Yard in Philly and do my best to discourage the mass poaching of bass in the spring. Unfortunately, I wasn't able to enforce fish and game laws and every time I'd call a WCO, they were either severely short staffed or hours away.

Well, with regards to the original video in the topic… I was informed that NY DEC is being contacted by a well-connected individual. He assures something will come of it.

I think this goes to show that if enforcement is understaffed and unable to do their jobs then fishermen need to keep each other honest . And if that means utilizing social media/forums to publicly “shame” or “expose” bad actors, so be it!

 

Maybe some flyers with incriminating photos in local tackle shops, almost like a wall-of-shame, would serve well.

And there lies a problem, law enforcement does not work on these people if there is no penalty
