Of either manslaughter or aggravated manslaughter. Acquitted of murder, robbery, etc.

 

The victim's mom testified: "I fear that I am forgetting little bits of her over time!" :( :(

 

In VA, the jury recommends the sentence --- 26 years (25 on the killing, 1 year on larceny) --- the sentencing range was 5 to 40 years.

 

Very sad. Apparently, the young girl, Ms. Love, and the defendant had a tumultuous and combative relationship.

Passion / provocation aggravated manslaughter as opposed to VA's murder 1 which is a knowing and intentional homicide or murder.

 

The judge has the right to impose a sentence lessor than 26 years.

 

I don't believe that the imposition of sentence should be the role of the jury. There are too many variables in terms of aggravating and mitigating factors and the powerful influence of emotion, as well as the comparison of this defendant and this act to others who are similarly situated.

 

I also believe that in VA a defendant must serve 85% of the top number as a mandatory minimum term, so that this is a hefty sentence.

USA Today and ABC are reporting Huguely is getting 25 years for Murder 2 and 1 year for larceny - he stole her laptop. :mad:

 

I wish they gave him the death penalty, the poor girl was alive for 2 hours, laying on her bed after the beating. If he had shown any remorse he might have gone back to check on her and could have saved her life.

There is some funky way they dole out good time credit for days served which nets out to 85%

 

 

 

I agree with you on the jury's role in sentencing... but would temper that statement by suggesting that there needs to be a way to cleanse the bench of ulterior motives as well.

Even worse, from what I understand, the men and women's teams are pretty close... friends and hanging out across the board... I remember the two getting together for her memorial services which were covered on the UVA campus...

 

overall a horrible shame and never, ever had to happen, period. The victim's family obviously lost a daughter, and this kid threw his life away for the inability to handle his emotions. He'll have a damn long time to think it over...

I'm curious if he believed there were details on the laptop about him that would make him look even worse... this dude seems to be a major headcase/loose cannon...

the kid seems like a sociopath to me.

There was a previous incident where he chocked her. It was admitted into evidence, perhaps to show motive or lack of accident ( there are limited reasons why you can enter evidence of prior violence). However, if the appellate court views this as evidence of his propensity for violence, this case might get overturned on appeal. Perhaps a risky move by the prosecutor --- not clean.
