U.S. Seals Court Records Of Border Patrol’s Murder

Last Updated: Wed, 11/23/2011 - 3:51pm

The Obama Administration has abruptly sealed court records containing alarming details of how Mexican drug smugglers murdered a U.S. Border patrol agent with a gun connected to a failed federal experiment that allowed firearms to be smuggled into Mexico.

This means information will now be kept from the public as well as the media. Could this be a cover-up on the part of the “most transparent” administration in history? After all, the rifle used to kill the federal agent (Brian Terry) last December in Arizona’s Peck Canyon was part of the now infamous Operation Fast and Furious. Conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), the disastrous scheme allowed guns to be smuggled into Mexico so they could eventually be traced to drug cartels.

Instead, federal law enforcement officers lost track of more than 1,000 guns which have been used in numerous crimes. In Terry’s case, five illegal immigrants armed with at least two semi-automatic assault rifles were hunting for U.S. Border Patrol agents near a desert watering hole just north of the Arizona-Mexico border when a firefight erupted and Terry got hit.

We know this only because Washington D.C.’s conservative newspaper got ahold of the court documents before the government suddenly made them off limits. The now-sealed federal grand jury indictment tells the frightening story of how Terry was gunned down by Mexican drug smugglers patrolling the rugged desert with the intent to “intentionally and forcibly assault” Border Patrol agents.

You can see why the administration wants to keep this information from the public and the media, considering the smugglers were essentially armed by the U.S. government. Truth is, no one will know the reason for the confiscation of public court records in this case because the judge’s decision to seal it was also sealed, according to the news story. That means the public or media won’t have access to any new or old evidence, filings, rulings or arguments.

A number of high-ranking Border Patrol officials are questioning how the case is being handled. For instance, they wonder why the defendant (Manuel Osorio-Arellanes) hasn’t been tried even though it’s been almost a year since Terry’s murder. They also have concerns about the lack of transparency in the investigation, not to mention the recent sealing of the court case.

Osorio-Arellanes is charged with second-degree murder. The four other drug smugglers fled the scene and their names were blacked out in the indictment. In 2006 Osorio-Arellanes had been convicted in Phoenix of felony aggravated assault and in 2010 he was twice detained for being in the U.S. illegally.

During a Senate Judiciary Committee hearing this month to address the flawed gun-tracking program, Attorney General Eric Holder said it’s not fair to assume that mistakes in Operation Fast and Furious led to Terry’s death. Holder also expressed regret to the federal agent’s family, saying that he can only imagine their pain.

You can see the video at the dailycaller.com site.

It is my belief that when you start hiding documents from the people, you have something to hide that won't stand scrutiny.

Holder lashes out at The Daily Caller while refusing to address growing calls for his resignation

Embattled Attorney General Eric Holder today demanded The Daily Caller stop publishing articles about the growing calls in Congress for his resignation because of the failed Operation Fast and Furious gun-walking program.

As Holder’s aide was escorting the attorney general offstage following his remarks Tuesday afternoon at the White House, a Daily Caller reporter introduced himself and shook Holder’s hand. The reporter asked him for a response to the growing chorus of federal legislators demanding his resignation.

Holder stepped towards the exit, then turned around, stepped back toward the reporter, and sternly said, “You guys need to — you need to stop this. It’s not an organic thing that’s just happening. You guys are behind it.”

Holder then walked offstage without answering TheDC’s request for comment about calls for his resignation.

Watch:

Fast and Furious was a Bureau of Alcohol, Tobacco, Firearms and Explosives program, overseen by the Justice Department, which facilitated the sale of thousands of weapons to Mexican drug cartels via straw purchasers. Straw purchasers are people who can legally purchase guns in the United States but do so with the intention of illegally trafficking them into Mexico.

At least 300 people in Mexico were killed with Fast and Furious weapons, as was Border Patrol agent Brian Terry.

Currently 52 members of Congress, three presidential candidates and two sitting Governors have called for Holder’s immediate resignation. Many of those lawmakers and political figures have issued statements exclusively to The Daily Caller in which they have called for Holder to step down. This is chiefly because TheDC is the most prominent mainstream media outlet covering this burgeoning international scandal. (RELATED: Members of Congress calling for Holder’s immediate resignation)

Holder is the nation’s leading law enforcement official and reports directly to President Barack Obama.

This was not the first time Holder has criticized The Daily Caller’s coverage of Operation Fast and Furious. In his first-ever unsolicited letter to Congress about the gun-walking operation on October 7, Holder criticized Rep. Paul Gosar for comments he made exclusively to TheDC. Gosar had said the Obama administration officials responsible for Fast and Furious were equivalent to “accessories to murder.”

Holder was the primary speaker at a White House event Tuesday intended to publicize a new national campaign stigmatizing the purchase of counterfeit consumer goods including clothing, medicines, software, songs and movies.

One of the ads unveiled during the event asked consumers not to buy such products because the money would help illegal gunrunners.

Not to derail or minimize what looks troubling in the OP but, one of the things I usually do with sites I am unfamiliar with is check their "About" link. I did this with Judicai Watch and found this in the very first sentence:

Judicial Watch, Inc., a conservative, non-partisan educational foundation, promotes transparency, accountability and integrity in government, politics and the law.

What?!?!?!?!:laugh: Gimme a break. Too effing funny. Somebody there is clueless or seriously deluded... LOL

^^^^Relax... read the first few words of my post...just found it funny...I am not questioning the veracity.

Of course, using the standards of many conservatives, I ought to say no it is not true. Anything from a "liberal non-partisan" site would have five pages of pretty funny comments and automatic dismissal as unreliable...do I really need to go there?

Do you think the lady to Holder's left is surprised by what is going on in that photo?

Or, does she always look like she is going 100MPH?

perhaps shes of the same genetic line as that lady who pops her eyes out of her head at will... or shes got some good schitt in her system... crumbs kicked down her way from the Holder....
