Wounded Warriors Face New Tax This Independence Day

As the America's veterans prepares to celebrate Independence Day with parades and barbecues, face a new tax on prosthetic limbs and other vital medical devices.

 

The health care overhaul passed by Congress and signed into law by President Obama earlier this year contains a new tax on medical devices such as prosthetic limbs, pacemakers, and wheelchairs. This tax, which its proponents claim will raise $20 billion over the next ten years, contains no exemption for the nation's 22 million veterans. In fact, Senate Democrats specifically refused to exempt veterans from the tax.

 

On March 24 2010, Senate Democrats rejected an amendment offered by Senator Orrin Hatch (R-Utah) to the healthcare bill. This amendment (SA 3644) would have prevented the medical device tax from hitting veterans covered by the Veterans Healthcare Program or TRICARE for Life. This amendment was rejected by a vote of 44-54. All but five Democrat senators voted in favor of retaining the tax for veterans.

 

The medical device tax was one of over twenty new or higher taxes in President Barack Obama's healthcare overhaul. This permanent new tax is being collected now.

 

"On March 24, Senate Democrats had the opportunity to exempt our veterans from Obamacare's new tax on medical devices such as prosthetic limbs. But 54 Democrats voted against the measure. They chose to side with the tax-and-spend crowd in Washington over our wounded warriors,"said Grover Norquist, president of Americans for Tax Reform. "This is one of the many reasons Harry Reid and the Democrats did not want Americans to read the 2,500 page health care bill before it was passed."

 

In addition to those who served in Afghanistan and Iraq, the Department of Veterans Affairs reports the following number of veterans from America's wars:

 

World War II: 2,079,000

 

Korean War: 2,507,000

 

Vietnam War: 7,569,000

 

Desert Shield/Storm: 2,254,000

My niece lost her leg to cancer at age 7. Because she's still growing, she periodically gets re fitted for a new prosthetic. You want to talk about a living hell. Now my brother has to worry about this too on top of praying it doesn't return? Nice going, scum bags.

Man oh man, these Liberals are some of the lowest sneakiest bastards I have ever seen, no wonder they did'nt want anybody to read that Health Care bill. It's all good though, come November their asses are history.

any taxable medical device by the manufacturer, producer, or

importer a tax equal to 2.3 percent of the price for which so

''(b) TAXABLE MEDICAL DEVICE.-For purposes of this section-

''(1) IN GENERAL.-The term 'taxable medical device' means

any device (as defined in section 201(h) of the Federal Food,

Drug, and Cosmetic Act) intended for humans.

''(2) EXEMPTIONS.-Such term shall not include-

''(A) eyeglasses,

''(B) contact lenses,

''© hearing aids, and

''(D) any other medical device determined by the Secretary

to be of a type which is generally purchased by

the general public at retail for individual use.'', and

the table of subchapters for such chapter the following new

item:

''SUBCHAPTER E. MEDICAL DEVICES''.

(b) CERTAIN EXEMPTIONS NOT TO APPLY.-

(1) Section 4221(a) of the Internal Revenue Code of 1986

is amended by adding at the end the following new sentence:

''In the case of the tax imposed by section 4191, paragraphs

(3), (4), (5), and (6) shall not apply.''.

(2) Section 6416(b)(2) of such Code is amended by adding

at the end the following: ''In the case of the tax imposed

by section 4191, subparagraphs (B), ©, (D), and (E) shall

not apply.''.

© EFFECTIVE DATE.-The amendments made by this section

shall apply to sales after December 31, 2012.

(d) REPEAL OF SECTION 9009 OF THE PATIENT PROTECTION

AND AFFORDABLE CARE ACT.-Section 9009 of the Patient Protection

and Affordable Care Act, as amended by section 10904 of such

Act, is repealed effective as of the date of enactment of that Act.
