Need Legal Advice in regards to an injury

My wife was in Vegas on business and she tripped in the hotel room and hurt herself pretty good. She was taken by ambulance to the hospital and treated. Ended up with a separated shoulder, bruised knee, injured toes and foot, bruised and swollen face, etc. The hotel did nothing to help her once she returned. A call was made to her room by the Claim Director - saying if they could do anything to just ask. She asked for an icepack the next day and she was told they were for emergencies only. Once they sent an EMS and security up to the room, they realized she was hurt and did need help. But that is where the help ended. Now, if we wanted to stay an extra night there, she would have had to sign a waiver of liability, and she didn't do that. Her injuries are being taken care of as a worker's comp case since she was injured while on business. Does she have a case for pain and suffering? It has been 4 weeks and she is still in a lot of pain and not back to her regular life.

She was caused to slip, trip, fall due to a dangerous and defective condition located withen the premises, and her injuries were caused by the negligence of the defendent (s) and/or said defendants servents, agents and/or employees in the ownership, operation, leasing management, maintenance, repair, inspection, control and supervision of the aforesaid premises............

I think the best advice you're going to get is to speak with an Attorney. The claim is in Vegas, so makes it more difficult. I'm not sure, because I'm not an Attorney, but I think she'd have to give back any workers' comp benefits if she won a settlement.

 

Despite what you hear on the news and the way TV adds would lead you to believe, you'd be surpised how little injury suits actually settle for, and when you net out the lawyers chunk (plus expenses) how much the plaintiff (Deb) actually gets.

 

If she is really hurt, then you should explore your options.

She's still pretty banged up. The orthopedic is talking about putting her in a cast for her foot. The is no visible fracture, but if she wears any shoe the doesn't lace up, it swells and causes a ton on pain. Her shoulder is doing well, but her neck is a problem, (and no, for once I'm not the pain in her neck) constant pain and if she makes any kind of sudden movement it really flares up the pain and stiffness.

Wait a second while I batten down the hatches in preperation for a flaming....

 

Not for nothing, but I'd tell her to suck it up and learn how to put one foot in front of the other and walk thru a threshold like everyone else.

 

I'm sorry she had an accident and is in pain, BUT I'm sick and tired (and I'm not saying your wife falls into this category mind you) of BS lawsuits that cost us all from people that nauture under Darwinian theory would have weeded out in the old days.

I hope your lady is well, and if not, she's well as soon as possible.

 

HOWEVER! Blaming people, and trying to sue everyones ass off for someone;'s own clitxieness or screwups is what's wrong with America. Is it really the hotels fault? Seriously? If I tried suing someone every time I efffed up, Id clogs the courts for decades after i was dad.
