Default Night Fishing Is Ok

Only ORVs have to be "off the beach" by 10PM.

I confirmed this with Cyndy Holda.

Fishermen can be dropped off, walk out, walk back anywhere in the Park, except within resource closures.

This a bright spot in this mess.

What I don't understand is why night driving is banned in areas that are not subject to breeding birds and that are not in the resource closure areas. The NPS and govt has no regulation on the books that prohibits night driving, and the NPS just told me that a violator would be in violation of the court order and not any actual federal regulation, and that authority for the new regulation comes from Judge Boyle. So, the federal judge has just created a new regulation when there is no actual regulation on the books that gives authority for banning vehicles at night. Also the decree only states driving and I do not see how they can stretch that to now say you cannot even just stay in one spot with no driving. Driving is driving, pretty simple definition. I am amazed that even areas with no resource closure nearby are now closed at night to vehicles. Does not seem to be commensurate with the intent of preserving the plovers. Would have been better to close the beaches 100% and then appeal the decision in my opinion. I hate to say it but why go anymore, minimal access and cannot be on the beach at night, which is when I mostly fished anyway.

still a deal breaker for me.........If I wanna walk on Ill do it here and not spend $400+ to do it.

Default Alright, let’s look at a night fishing weekend.

For a typical commando weekend run with the new rules...

Leave home on Friday so I get to Buxton around 9:00 pm, 5 hour drive so need to leave work early. Get out to the point (that is IF it is not closed…). Drop off gear and the dog. She’s not as young as she’d like to think she is and I’d end up carrying her most of the way back if she was to walk. Drive out and park the Jeep. Wait for a ride out or more than likely walk back to my stuff. Get back to the gear, setup a tarp to keep sand and wind from ruining all my expensive fishing crap. Also as a wind break/shelter for that unexpected storm, would this be considered ‘camping’ then and illegal perhaps??? Anyway, bait up, cast out and make dinner. Everyone knows fish always bite when you are eating something. Fish the night away! After the morning bite, make breakfast and either wait for someone to arrive and leave so I can hitch a ride or walk back to get the Jeep. Drive back out to the base camp and load up all my junk and the dog. Hit the motel for a nap and shower. Drive back out later in the afternoon, drop off stuff and the mutt. Drive out and park the Jeep, walk or hitch back to my stuff. Bait up, cast out and get gear arranged for Saturday night. Make dinner and fish the night away! In the morning, make breakfast, fish the morning bite and again walk or wait for a ride back to my vehicle. Get the Jeep, drive back out to my stuff, load up and head for home. Heck, that doesn’t sound all that bad, does it?

I believe the night driving thing was brought about in case some stray turtle comes ashore.The problem you may find with your shuttle is if they check the beach in AM it may close between your base camp and vehicle.The night driving things sucks IMO it needs to change.The 6 am things sucks also you will miss the tide on some days and the sunrise and magic hour bite is out.I can see it now everybody lined up in am to go out.This will be another log for the ANTIS fire.

In the summer months the best time for Spanish fishing is right at daylight. You want to be there at first light and now that is taken away.

Spring and Fall, some of the best Drum bites are in the wee hours...10pm-6am.

I can just see the pictures of all the vehicles lined up and all the propagand stating "look how many vehicles are there waiting to destroy the beaches".

there is no bright spot sorry

as expected:

point closed
ocracoke closed
oregon inlet closed

You might find some flat beach along avon to fish some until the auto-ban folks decide to close that too

expect the closures to expand and be semi-permanent

and you really can't fight it thanks to all the MORONS who accepted the consent decree

Yeah,
I'm pretty sure there is no pedestrian access either. Read it on another board, but almost positive. Sad day. I'm headed down this weekend.
