Good Afternoon…………..

April 4, 2008 4pm……Jim Keene, NCBBA President has just informed me that Judge Boyle has postponed his decision and charged the attorneys involved to “continue their negotiation” on resolving this issue. The Judge did promise to render a decision on April 12 at the Federal Courthouse in Raleigh at 2 pm.

I was able to be there after all. And I'm glad that I was, because I met some nice folks.

Judge Boyles decision to grant a continuance was a surprise. It started off sounding like he was going to issue an injunction.

Turns out that he had more insight into the issues than I had been led to believe. Whatever the opposing parties consent decree proposal looks like next Friday, I left with a feeling that Judge Boyle will do the right thing.

We haven't won yet, but I feel better about the potential outcome now.

NCBBA President Jim Keene, along with the other attendees at the hearing, were contacted this evening by the attorneys for CHAPA asked that a clarification be sent to all interested parties in this injunction…..Judge Boyle did not set a new hearing date as I previously reported to you and has charged the attorneys “to continue their negotiations”.

The AP newswire which some of you have read is incorrect as was my previous email. Expect to see a correction in tomorrow’s paper and on the internet websites very soon…..Mike Metzgar
